1. TV18 Broadcast Limited is the Campaign Organizer ("Organizer") and ICRA Analytics Limited is the process partner ("Process Partner") and the term Process Partner shall be deemed to include and be considered as Organizer.
  2. The Campaign shall - starts on December 8th 2020and ends on 31st March 2021 ("Campaign Period"), the last date to submit Online Questionnaire is 28th February 2021 ("Entry Period"). The organizer shall have the right to modify the timelines.
  3. Entities that are fully or partially owned by the government or under direct control of any government authority or is otherwise considered a state entity or a public sector undertaking are not eligible to participate in this Campaign.
  4. The participant shall fill true, complete and accurate information in the online questionnaire ("Online Questionnaire") relating to the Participant and Participant's IT infrastructure and capabilities to participate in the Campaign.
  5. A Participant cannot apply more than once in the campaign nor.can- win more than once in this Campaign.
  6. Efforts will be made to adhere to the defined timelines. However, the defined timelines are subject to change based on circumstances. Any liabilities on account of any disruptions/stoppages/interruptions or cancellation of the Campaign or any part of its processes on account of any factors beyond the control of Organizers are disclaimed.
  7. The Online Questionnaire submitted last in time before the expiry of Entry Period shall be considered final, accurate and best to the knowledge of the Participant. We are not responsible for excess, lost, late, or incomplete Online Questionnaires. If disputed, Online Questionnaires will be deemed submitted by the authorized account holder of the email address, social media account, or other method used to enter the Campaign.
  8. Any wrong, inaccurate, or confusing information provided in the Online Questionnaire submitted by any Participant may result in immediate disqualification of that Participant from this Campaign and no further communication will be entertained in this regard.
    • The Campaign is designed to encourage Participants to leverage cloud technologies and have a more robust and agile IT infrastructure to support its business operations and to reward as benefits the Participants who have excelled at using these technologies. It is the objective of the Participant to provide true, correct, accurate and complete information about the Participant and its IT Infrastructure and capabilities in the Online Questionnaire.
  9. The Participant must have all consents, approvals, or licenses required for it to submit the information provided under the Online Questionnaire.
  10. The Participants shall validate or otherwise provide verification or documentary evidence for the accuracy of the information provided in the Online Questionnaire to the satisfaction of Organizer in order to be eligible to receive any benefits under this Campaign.
  11. Winner Selection: Pending confirmation of eligibility or verification of the accuracy of the information provided in the Online Questionnaire, the Process Partner will shortlist select Participants basis the information relating to its IT infrastructure, capabilities and growth potential. Participants shortlisted by the Process Partner will be required to interact with the members of a jury constituted specifically for this Campaign by the Organizer ("Jury"). The Jury will consider various factors of the Participant including its growth path, digital journey envisioned and the impact of the Participant in relevant industry to select one (1) winner each month from January to March of the Campaign Period. Accordingly, there will be three (3) winners under this Campaign. Efforts will be made to communicate to the winner as early as possible. The decision of the Jury shall be final and binding.
  12. The following are the benefits that each Winner is eligible to receive under this Campaign;
    • One day Product Training for 10 employees of the Winner. Training will cover the products implemented across 6 solution offerings.
    • 6 hours of executive coaching for 5 employees of Winner by Trainer Linnet Dave worth INR 1,50,000.
    • Up to one hundred (100) Licenses of M365 Business Premium Licenses with 4 months validity worth INR 5,28,000
      Note: If the Winner does not have the requirement of 100 Licenses then the number of Licenses received as benefit will be accordingly reduced
    • Ten (10) Licenses of Dynamics 365 Sales Enterprise with 3 months validity and Ten (10) Licenses of Power Automate or Power App with 3 months validity worth INR 2,48,193
      Note: If the Winner does not have the requirement of 10 Licenses then the number of Licenses received as benefit will be accordingly reduced
    • One unit of Surface Laptop 3 (i5, 16GB, 256GB, 13.5") worth INR 1,48,899
      Note: The recipient of the Surface Laptop 3 will have to additionally agree to a giveaway form as may be required
    • Publicity and brand promotion of Winner on TV18 selected media and digital platforms.
    • Winners assuring a minimum monthly recurring revenue of INR 3,76,050 on Azure will be eligible to receive Azure Credits with 60 days validity worth upto INR 3,76,050
      Note: Credit value is customizable as per size of engagement and is limited to a maximum of INR 3,76,050.
    • The approximate value in INR of all the benefits that are made available to each Winner under this Campaign is Rs. 14,51,152 The approximate value of benefits is subject to price fluctuations.
  13. No more than the stated number of benefits will be available under this Campaign. No substitution, transfer, or assignment of the benefits is permitted, except that Organizer reserves the right to substitute a benefit or a component of the benefit of equal or greater value in the event the offered benefit is unavailable. Winners may be required to complete and return benefit claim form and/ or tax forms within the deadline stated in the winner notification. Taxes on the benefit, if any, are the sole responsibility of the Winner, who is advised to seek independent counsel regarding the tax implications of accepting a benefit under this Campaign.
  14. By accepting the benefits under this Campaign, the Winner agrees that its senior employees and officials will participate in preparation of a video comprising of interviews or discussions relating to benefits of leveraging Microsoft Products and Services on their business as may be safely practicable as per prevailing circumstances and that Microsoft or the Organizers may use their names, image, such videos and images of the Winner's brand and their senior employees and officials for commercial and marketing purposes in online and in print, or in any other media, in connection with this Campaign without payment or compensation to Winner or its employees, except where prohibited by law.
  15. Benefits shall neither be transferable nor exchangeable for cash or otherwise. Mere participation in the Campaign shall not entitle a Participant to a benefit. No other person or agent can claim the benefits on behalf of the Winners. This Campaign cannot be clubbed with any other offer or promotion otherwise available to the Participant.
  16. Participants may be contacted for any additional information to verify the information provided. Such information sourced from the participants may be considered as a part of the Online Questionnaire submitted by the Participant as per the discretion of the Organizer or the Jury.
  17. Organizer have the right to ask for documentary proof of information. If such a request is made and a participant does not comply within four working days from the date the request is made, the participant may be disqualified from this Campaign.
  18. Information provided by a Participant will be kept confidential.
  19. Organizer will try to contact the Participants for the purposes of the Campaign on best effort basis by reasonably appropriate means.
  20. In the event it is not possible to contact any participant to obtain information from him/her, interview him/her, etc. such participant will be disqualified from further participation in this Campaign.
  21. Last date for receiving completed nomination forms, is 28th February 2021 end of Entry Period.
  22. The Organizer, Process Partner, Microsoft ("Sponsors") or their employee/ agent shall NOT be liable for: (a) any costs incurred or loss or liability suffered by the participants in relation to the Campaign, whether directly or indirectly; (b) any loss in expectation of profits by participants (c) any failure by participants to understand their rights and liabilities. (d) Any other benefit the participants may expect to gain by participating in this Campaign.
  23. Under no circumstance, shall the Organizers, Sponsors and their directors, employees, officers, affiliates or subsidiaries, be liable to the Participants and/or to any third party for any lost profits or lost opportunity, indirect, special, consequential, incidental, or punitive damages or for any other reasons whatsoever, even if the Organizers and Sponsors have been advised of the possibility of such damages.
  24. The Participants specifically agree and undertake not to file in person or through their representatives, any applications, criminal proceedings, and civil suits, in any court or forum in India or abroad against the Organizers, Sponsors, Process Partner and/ or their directors, employees, officers, affiliates or subsidiaries to claim any damages or relief in connection with the Campaign.
  25. The Organizers and Sponsors shall not be responsible for any loss of Online Questionnaire for any reason, whatsoever including, due to any problems caused by telephone lines, service providers, network breakdowns, computer service delays, interruptions, network failures, overloads etc.; or for lost, misdirected or misplaced Online Questionnaires, or for Online Questionnaire received after the Entry Period; or for any reasons beyond the control of the Organizers.
  26. Participants agree to indemnify and hold Organizers, Sponsors and Process Partner and their officers, affiliates, successors, assigns, directors, officers, agents, service providers, suppliers and employees, harmless from any claim, damages, losses or demands, including reasonable attorney fees and court costs, arising out of their participation in the Campaign or for any reason whatsoever, including but not limited to civil suit or criminal action due to breach of representations made by the Participants.
  27. All other incidental costs, if any, that may arise from participation in the Campaign will be borne by the participants.
  28. The participants/ winner(s) acknowledge that the Organizers, Process Partner and Sponsors shall not be liable for any costs, expenses, charges, fees, taxes, etc. incurred by the participants/ winner(s) in participating in the Campaign, and the participants/ winner(s) shall be absolutely responsible and solely liable for the same.
  29. The participants shall not be entitled to receive any benefits simply by reason of participating in the Campaign. Further, the winner(s) so selected shall be entitled to receive benefits as set out here in above.
  30. Apart from the entitlement to the benefits, the winner (s) will have no other right or claim against the Sponsors.
  31. By participating in the Campaign, the participants agree to be bound by all terms and conditions, rules and regulations, guidelines or policies associated with the Campaign, including without limitation these Terms and Conditions, and agree to be bound by any rules and decisions made by the Organizers including its Process Partner, including any interpretations of such rules by the Organizers.
  32. In the event of any force majeure event beyond the control of the Organizers or Sponsors, and the Campaign not being made available to the winner, the winner shall not have any right to claim any damages or monies from the Organizers,Process Partnerand Sponsors and by participating in this Campaign the winner(s) waive their right to make any claims against the Organizers andSponsors.
    • For the purpose of this Campaign, 'force majeure event' shall include fire, earthquake, flood, epidemic, war, epidemics and / or pandemics, acts of God, government rules and restrictions and any other acts which are beyond the control of the Organizer and Sponsors which cannot reasonably be forecasted or provided against, and cannot be predicted by men of ordinary prudence and which prevent or delay the performance of any of the obligations of the Organizers and Sponsors.
  33. The Organizer reserves the right to change/modify these Terms and Conditions and/ or criteria of the benefits at any time of their own sole discretion and without any prior notice and without assigning any reason to anybody whatsoever.
  34. The participants acknowledge that the participants will not hold the Organizers, Sponsors and, Process Partner and/or any of its affiliates or agencies engaged by them with regard to this Campaign liable for any loss of opportunity, monetary loss due to their participation in the Campaign. The Organizers, Process Partner and Sponsors are not responsible for any errors or omissions in the terms and conditions contained herein. All information is provided 'As is' without warranty of any kind. The Organizer, Process Partner and Sponsors make no representations and disclaim all express, implied and statutory warranties of any kind to the participants and/or any third party including, without limitation, warranties as to accuracy, timeliness, completeness, merchantability, or fitness for any particular purpose, except where prohibited by law.
  35. The participants agree and warrant that they shall procure from their representatives who participate on their behalf in the Campaign irrevocable consent in perpetuity to enable TV 18 Broadcast Ltd and ICRA Analytics Limited to use such representatives' names, photographs, video tape(s) taken during the Campaign, in any and all modes, media and formats including but not limited to radio, broadcast, television, newspapers and magazines for including but not limited to advertising, commercials, promotion, stories, text, articles and commercial exploitation, at any time without further notice to or consent from such representatives and the participants hereby agree to fully indemnify and hold harmless TV 18 Broadcast Ltd and ICRA Analytics Limited from including any claims, losses and damages suffered by TV18 Broadcast Ltd and ICRA Analytics Limited due to participants breach of its warranties herein.
  36. The participants hereby agree and undertake that they shall not accept or undertake to accept or give or undertake to give, either directly or indirectly, any gifts, commission or other favor, of any kind whatsoever, to facilitate their winning in the Campaign. Any act/alleged act shall lead to immediate disqualification of such participants and the Organizers, Process Partner / Advisor shall be entitled to take any and all action(s) against such participants, as deemed fit by them.
  37. PRIVACY: The information submitted by a Participant during the registration process or otherwise when participating in the Campaign may include email address, ID number and other personal information ("Personal Information"). By entering this Campaign you consent to the use of personal information as described. Except as provided elsewhere in these Terms and Conditions, your Personal Information may be shared with Microsoft in accordance with applicable data protection laws and regulations and Microsoft’s privacy policy.(https://privacy.microsoft.com/en-us/privacystatement)
  38. In case of any dispute, controversy, claim or difference arising out of or relating to this Campaign, the decision of the Organizers shall be final and binding on the Participants.
  39. The Campaign shall be governed by the laws of India subject to the exclusive jurisdiction of competent court/s at Delhi.
