A California Jury rejected the claims that Tata Consultancy Services (TCS) discriminated American workers and was in favour of staffing its US offices with Indians.
The federal jury in Oakland, California, sided with TCS against four former employees who claimed that were sidelined and fired because they are not South Asian.
"We have always maintained, the claims made in this case were baseless and we are gratified that the jury agreed ... the decisions we make about the hiring and retention of employees are based purely on their capabilities and fit in serving our customers' business needs," a TCS spokesperson said.
The former employees that sued the company said TCS follows a “systematic pattern and practice of discrimination” by favouring Indian ex-pats and visa-ready workers from India for US positions.
However, TCS said it hires its employees irrespective of their background or national origin.
Indian IT companies, in the past, have been accused of a hiring bias in the US and have gone to trial. HCL Technologies, Infosys and Wipro are among the IT firms facing such claims.
Please find below statement from TCS on being cleared by the Jury members on the class action suit on. Please attribute it to TCS Spokesperson
We have always maintained, the claims made in this case were baseless and we are gratified that the jury agreed. The success of TCS rests on the talents, expertise and deep industry knowledge of our employees, who help our customers in their growth and transformation journeys. So the decisions we make about the hiring and retention of employees are based purely on their capabilities and fit in serving our customers' business needs.
Irrespective of their background or national origin, we will continue to invest in our people, provide ongoing digital training and empower them to succeed at TCS and, more importantly, enable our customers’ success.
TCS is a global company. The United States is the world's business and technology leader and very important to TCS, where we have been operating for over 40 years. Skilled American workers are critical to the success of the US business and to the nation’s economic success, and we will continue to invest heavily in the country’s workforce, academic alliances and our extensive youth STEM education initiatives.
